Welcome to Super Veggie Delivery. Please read on to learn the rules and restrictions that govern your use of our website(s), mobile application(s), products, and services (collectively, the “Services”), including any request to receive information about or purchase products made available through our Services (“Products”).
YOU MUST BE A LEGAL ADULT IN YOUR JURISDICTION (18 OR OLDER IN MOST U.S. STATES) TO USE THESE SERVICES. By using the Services, you agree to these Terms of Service (“Terms”), which form a binding contract between you and Super Veggie Delivery (“we,” “us,” or “our”). If you do not agree to these Terms, you may not access or use the Services.
These Terms include important information about your rights and obligations, including arbitration and class action waivers. Please read them carefully.
Super Veggie Delivery provides ready-made organic meals, which can be purchased as individual orders or through subscription plans.
You represent and warrant that you:
- Are at least 18 years old.
- Reside in the United States.
- Have not been previously suspended or removed from the Services.
- Have full authority to enter into these Terms and use the Services.
3. Account Creation and Security
- Account Creation: You may be required to create an account to use certain features of the Services. You agree to provide accurate and complete information and to keep this information up-to-date.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account. Notify us immediately if you suspect unauthorized use.
4. Orders and Payments
- Order Acceptance: All orders are subject to acceptance by Super Veggie Delivery. We reserve the right to refuse or cancel any order for any reason.
- Payment Methods: By providing a payment method, you authorize us to charge your payment method for all purchases, including applicable taxes and fees.
- Pricing and Availability: Prices are in U.S. dollars. We reserve the right to adjust prices, fees, and availability of Products without prior notice.
- Product Labels and Best By Dates: If we do not have updated physical labels available at the time of fulfillment, we may use prior labels that display an outdated "Best By" date. In those situations, we will include the correct date inside the box or notify you by email, and we are happy to provide the accurate date for any order via email upon request. Unless we inform you otherwise, the "Best By" date is three months after you receive the Product when it is stored frozen because we prepare items fresh each week.
5. Subscription Services and Recurring Billing
- Overview: Subscription plans include recurring charges for periodic deliveries. By subscribing, you accept responsibility for these recurring charges.
- Cancellation: You may cancel your subscription at any time through your account settings. If you cancel after an order cutoff, you may still be charged for the next delivery.
6. Refunds and Returns
- Return and Refund Policy: Refunds are granted based on our Return and Refund Policy.
- Non-Refundable Items: Due to the perishable nature of our Products, certain items may not qualify for refunds.
7. Delivery and Shipping
- Delivery Areas: We deliver to select areas in the USA. Verify availability for your location before placing an order.
- Delivery Conditions: Products are packaged to maintain quality during transit. Inspect your delivery upon receipt and contact us immediately if there are issues.
- Risk of Loss: Ownership and risk of loss transfer to you upon delivery.
- Holiday Shipping Delays: Please note that shipping times may be affected by holidays, inclement weather, or high-demand periods. Orders placed around holidays may require extended shipping windows to ensure product quality and delivery. We will notify you of any anticipated delays, and you are encouraged to place orders well in advance during holiday periods.
- Address Accuracy: You are responsible for providing the correct shipping address at the time of purchase. Please carefully review and confirm the address in your order confirmation email. Super Veggie Delivery is not responsible for delays or lost shipments due to incorrect or incomplete addresses provided by the customer. If an error is identified, contact us immediately to resolve the issue before shipment.
- Frozen Shipments: Products are shipped frozen and may arrive partially thawed. As long as the contents are at or below standard refrigerator temperatures (40°F / 4°C), they remain safe to store and consume according to the provided Best By date, and you may refreeze them upon receipt.
- License: We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.
- Prohibited Conduct: You agree not to:
- Use the Services for unlawful purposes.
- Interfere with the operation of the Services or attempt unauthorized access.
- Use automated systems to extract data from the Services.
- Resell, redistribute, or otherwise commercially exploit the Products or any portion of the Services without our prior written consent.
All content, logos, trademarks, and designs are owned by Super Veggie Delivery or its licensors and are protected under applicable intellectual property laws.
- Promotions: Terms for promotions, discounts, and gift cards will be provided at the time of issuance. Promotions cannot be combined with other offers unless stated otherwise.
- Gift Cards: Gift cards are non-refundable and subject to additional terms at the time of purchase.
We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for behavior that we believe violates these Terms or is otherwise harmful to other users or Super Veggie Delivery.
The Services are provided "as is" and "as available." We make no warranties, express or implied, regarding the Services or Products, including warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, Super Veggie Delivery is not liable for indirect, incidental, special, or consequential damages arising from the use of the Services or Products.
14. Dispute Resolution and Arbitration Agreement
- Arbitration: Any disputes shall be resolved through binding arbitration under the Federal Arbitration Act.
- Class Action Waiver: You agree not to participate in any class or representative action against Super Veggie Delivery.
- Opt-Out: You may opt out of the arbitration agreement within 30 days of first agreeing to these Terms by contacting us in writing.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
These Terms, including our Privacy Policy and any other legal notices published by Super Veggie Delivery, constitute the entire agreement between you and Super Veggie Delivery regarding the use of the Services.
We may update these Terms from time to time. If material changes are made, we may notify you through the Services or via email.
18. Reward Points and Referral Program
Super Veggie Delivery operates a loyalty rewards program that allows customers to earn and redeem points for discounts on purchases.
- Purchase Points: Customers earn 1 reward point for every dollar spent on qualifying purchases (calculated before taxes, shipping, and discounts).
- Referral Signup Bonus: New customers who sign up through a referral link receive a one-time credit of 400 reward points (equivalent to $40) toward their first order.
- Referrer Rewards: When a referred customer places a qualifying first order that isn't canceled or refunded, the referrer earns 400 Super Veggie Reward Points (worth $40) after a 14-day verification period.
Points Status and Availability
- Pending Points: Referral points remain pending for 14 days after the referred customer's order ships. After this verification period, valid points become available for use.
- Available Points: Points that are available can be redeemed immediately at checkout toward future purchases.
- Points Expiration: Reward points may expire 90 days after they are earned if expiration is enabled. You will be notified before points expire.
- Redemption Value: Each reward point is worth $0.10 (10 cents) when redeemed.
- Minimum Charge Requirement: When redeeming points at checkout, at least $1.00 must be charged to a payment method. Points cannot reduce your order total below this minimum.
- Redemption Process: Points can be applied at checkout by selecting the amount you wish to redeem, up to your available balance and subject to the minimum charge requirement.
Refunds and Points
- Purchase Refunds: If you receive a refund for a purchase on which you earned points, those points will be deducted from your available balance. If your balance is insufficient, it may become negative.
- Redemption Refunds: If you receive a refund for a purchase where you redeemed points, those redeemed points will be restored to your available balance.
- Partial Refunds: For partial refunds, points will be adjusted proportionally based on the refunded amount.
- No Cash Value: Reward points have no cash value and cannot be exchanged for cash.
- Non-Transferable: Points cannot be transferred between accounts or to other individuals.
- Administrative Adjustments: Super Veggie Delivery reserves the right to adjust point balances for administrative reasons, including corrections, fraud prevention, or abuse.
- Program Modifications: We reserve the right to modify, suspend, or terminate the rewards program at any time. Changes will not affect points already earned, but may affect future earning or redemption rules.
- Abuse and Fraud: Self-referrals, duplicate accounts, suspicious activity, or any attempt to manipulate the rewards program may result in forfeiture of rewards and account termination.
- Limitations: Referral benefits are limited to new customers only.
